VI. DELIVERY.
35. The price/costs for the delivery of the goods are for the account of the user and are charged and paid in addition to the prices of the goods indicated in the Electronic Store.
36. The products ordered from the Electronic Store are delivered within the following terms:
36.1. For the territory of the Republic of Bulgaria - up to 5 /five/ working days starting from:
• the payment of the price, in case payment of the price of the goods by bank transfer or by card is chosen;
• the order, in case payment of the price of the goods upon delivery has been chosen, with cash on delivery.
37. Deliveries to settlements/addresses in the Republic of Bulgaria are carried out through a courier company, and the delivery prices are in accordance with the current price offer of the specified courier company.
38. In case of impossibility to deliver the shipment, created due to the recipient's fault or cause, after the expiration of 2 days from the date of non-delivery of the shipment for the specified reason, storage costs will be charged at the expense of the recipient (user) (or " store"), in the amount of BGN. for each day of the shipment's stay with the courier company, due to the fault of the user and/or the recipient of the goods.
39. The merchant is not responsible for inaccurate and/or delayed performance, when this is due to a delay due to the fault of the courier/transport company and/or an incorrect or incomplete address, contact person and/or telephone specified by the User, as well as in other cases , circumstances beyond the Merchant's control.
40. Upon receipt of the shipment with the goods, the user/recipient of the goods must check the goods in the presence of the courier, respectively, must check the contents of the package for compliance of the goods with the order. In the event of a demonstrable discrepancy between the goods received and those ordered, the Electronic Store replaces the goods at its own expense, without additional charges for the User.
41. In case of missing goods, demonstrably found by the User upon receipt of the order, the STORE may offer alternative products/goods of the same value. If the User refuses to exchange the products, the STORE will refund the corresponding amount.
42. Consumers should bear in mind that the Consumer Protection Act provides legal guarantees for the safety of goods and services and for the conformity of the goods with the sales contract, which are legally enshrined in Chapter V of the Consumer Protection Act )! In the event of a non-conformity/defect of a product purchased through the Electronic Store, the rules under Chapter V, Section II and Section III of the PPE are applicable, and for filing complaints, the user can contact the merchant/supplier of those specified in Section I, under - above from these General Terms and Conditions addresses, telephones, e-mail addresses.
43. In case of violations in the packaging and/or in the appearance of the goods, which occurred during the transport, you should contact the courier to draw up a protocol for a damaged shipment!
44. VII. RIGHTS AND OBLIGATIONS UNDER THE CONSUMER PROTECTION ACT
45. Through the orders placed under the conditions of the Electronic Store and/or in accordance with the functionalities of the Electronic Store, the Merchant, as a Supplier, concludes distance sales contracts with consumers, within the meaning of the Consumer Protection Act, of the goods offered for sale/sold in the Electronic Store.
46. The main characteristics of the products/goods sold in the Electronic Store are described in the Electronic Store on the page/place for presenting the relevant product on the Electronic Store website.
47. The final price of the goods is written on the presentation page of the relevant product, right next to the name of the goods. The value of transport costs for delivery is NOT INCLUDED in the price of the goods. It is determined and charged additionally when ordering, according to the method of delivery, being charged additionally to the price of the goods when determining the final price for payment.
48. The provider does not charge users costs for using a means of communication to conclude the distance sales contract.
